On-The-Go PC Builders Terms and Conditions

Effective Date: April 14th, 2024. Thank you for choosing On-The-Go PC Builders. These Terms and Conditions govern the sale of products and services provided by On-The-Go PC Builders ("OTG", "we", "our", or "us"). By placing an order, requesting service, or engaging with our business, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

1. Agreement to Terms

By purchasing products or services from On-The-Go PC Builders, you agree to be bound by these Terms and Conditions. We reserve the right to amend these Terms and Conditions at any time. Updated versions become effective immediately upon publication on our website unless otherwise stated.

2. Services

On-The-Go PC Builders provides, but is not limited to, the following services: Custom-built desktop computers; pre-designed gaming and workstation computers; computer diagnostics and repairs; hardware upgrades and installations; SSD and storage upgrades; data migration services; Windows installation and software configuration; networking and Wi-Fi solutions; in-home technical services; pickup and delivery services (where available)

3. Orders and Payment

Full payment is required before an order is processed unless otherwise agreed to in writing. Orders may be placed online, by email, by telephone, or in person. We accept approved electronic payment methods, including major credit cards and Interac e-Transfer.Prices are subject to change until payment has been received and the order has been confirmed. An order is considered processed once component purchases have been submitted to our suppliers.Once an order has been processed, it cannot be cancelled, modified, or refunded, as components have been specifically purchased for your order.

4. Custom-Built Computers

Every custom-built computer is assembled specifically to the customer's requested specifications. Full payment is required before component ordering or assembly begins unless otherwise agreed to in writing.Customers are responsible for reviewing and approving all quoted specifications before placing an order. Once component purchases have been submitted to our suppliers, the order is considered processed and cannot be cancelled, modified, or refunded.All custom-built systems are final sale and are not eligible for returns or refunds except where required under applicable law or covered by our warranty.

5. Pre-Designed Computer Systems

Although marketed as pre-designed systems, every On-The-Go PC Builders computer is built to order using brand-new components sourced specifically for each customer. Estimated build and fulfillment time is generally 1-2 weeks from the date payment is received.All quoted timelines are estimates only and are not guaranteed.Build and delivery timelines may be affected by circumstances beyond our control, including but not limited to: Supplier inventoryavailability, Manufacturer backorders, Inventory discrepancies, Shipping or courier delays, Customs delays, Weather events, Quality control inspections Damaged or defective components requiring replacement, Supply chain disruptionsOther unforeseen circumstances While we make every reasonable effort to complete every order within our estimated timeframe, On-The-Go PC Builders does not guarantee build or delivery dates. Customers will be notified of any significant delays whenever reasonably possible. Once supplier orders have been submitted, the order is considered processed and cannot be cancelled, modified, or refunded. All pre-designed systems are final sale except where required by law or covered by our warranty.

6. Component Availability and Substitutions

Every system is built using new components sourced from authorized manufacturers and distributors. Due to the nature of the computer hardware industry, component availability can change without notice, including situations where products appear available but are later found to be out of stock, discontinued, delayed, or backordered.On-The-Go PC Builders reserves the right to substitute a component with one of equal or greater performance, quality, reliability, and compatibility when the originally selected component is unavailable or cannot be obtained within a reasonable timeframe.Equivalent substitutions may include a different manufacturer or brand and do not require customer approval, provided the replacement component does not reduce the overall performance, functionality, reliability, or value of the computer system. If a substitution would materially affect the system's performance, functionality, features, appearance, or overall price, we will contact the customer before proceeding.Component substitutions may affect estimated build timelines.

7. Shipping and Delivery

Systems are shipped only after assembly, quality assurance, and testing have been completed. Shipping and delivery dates are estimates only.Shipping charges are calculated separately unless otherwise stated. Customers are responsible for any customs duties, brokerage fees, or import taxes where applicable.Risk of loss or damage transfers to the customer upon delivery or customer pickup. Customers should inspect shipments immediately and report shipping damage within 48 hours of delivery.

8. System Testing and Customer Acceptance

Every custom-built and pre-designed computer undergoes quality assurance before shipment or pickup. This includes, where applicable: Hardware verification, BIOS configuration, Windows installation and activation (if purchased)Driver installationThermal testingStability testingStress testingFinal quality inspection. Customers should inspect their computer immediately upon receipt and notify On-The-Go PC Builders within 48 hours of any shipping damage or hardware issues discovered upon arrival.

9. Repairs, Diagnostics and Data Protection

Diagnostic fees are non-refundable. Repair estimates are based upon issues identified during inspection and may change if additional faults are discovered.Repairing one issue does not guarantee unrelated failures will not occur in the future.While every reasonable effort is made to repair equipment or recover data, no guarantee of successful repair or recovery is provided. Customers are solely responsible for maintaining current backups of all important files before service begins.Hardware failures, storage device failures, Windows installations, firmware updates, software repairs, malware removal, and hardware replacement may result in partial or complete data loss. On-The-Go PC Builders accepts no responsibility for lost, corrupted, inaccessible, or unrecoverable customer data.We may install firmware updates, BIOS updates, drivers, operating system updates, or replacement components as reasonably necessary during the repair process.

10. Warranty

Unless otherwise specified, all custom-built and pre-designed computers include a 12-month labour warranty.Individual hardware components are covered by their respective manufacturer's warranty. Manufacturer warranty periods vary by component.Warranty coverage does not include: Accidental damagePhysical abuseLiquid damageFireLightningPower surgesCosmetic damageImproper transportationUnauthorized repairsCustomer modificationsImproper installation by third partiesMalware, ransomware, or virusesSoftware corruption after deliveryOverclocking beyond manufacturer specificationsCryptocurrency mining or commercial workloads outside the intended design of the systemNormal wear and tear

11. Abandoned Equipment and Storage

Customers are responsible for collecting repaired equipment promptly after notification. Equipment remaining unclaimed for more than 30 days may be subject to reasonable storage charges.Equipment remaining unclaimed for 90 days after reasonable attempts to contact the customer may be considered abandoned, subject to applicable Nova Scotia law. On-The-Go PC Builders reserves the right to dispose of, recycle, sell, or otherwise recover costs associated with abandoned equipment as permitted by law.Outstanding repair charges, storage fees, disposal costs, and any other unpaid balances remain the responsibility of the customer.

12. Force Majeure

On-The-Go PC Builders shall not be liable for delays or failures to perform resulting from events beyond our reasonable control, including but not limited t o: Supplier shortagesManufacturer delaysShipping disruptionsLabour strikesCustoms delaysNatural disastersSevere weatherFireFloodPublic health emergenciesGovernment actionsUtility failuresInternet outagesCybersecurity incidentsAny other unforeseen circumstance beyond our reasonable control.Any quoted timelines shall automatically be extended for the duration of such delays without liability.

13. Limitation of Liability

To the fullest extent permitted by law, On-The-Go PC Builders shall not be liable for any indirect, incidental, consequential, exemplary, special, or punitive damages arising from the purchase, repair, installation, shipment, or use of any product or service.This includes, but is not limited to: Loss of data, Loss of business, Business interruption, Downtime, Replacement equipment costs, Third-party claims. Our maximum liability for any claim shall not exceed the original purchase price paid for the affected product or service.

14. Intellectual Property

All logos, branding, website content, documentation, photographs, graphics, marketing materials, and other intellectual property created by or belonging to On-The-Go PC Builders remain our exclusive property and may not be reproduced or used without prior written permission.

15. Privacy

Customer information is collected solely for the purpose of providing products, services, warranty support, invoicing, and business communications. On-The-Go PC Builders does not sell customer information to third parties.Please refer to our Privacy Policy for additional information.

16. Governing Law

These Terms and Conditions are governed by the laws of the Province of Nova Scotia and the applicable laws of Canada. Any legal proceedings arising from these Terms and Conditions shall be brought exclusively before the courts of Nova Scotia.

17. Changes to These Terms

On-The-Go PC Builders reserves the right to modify these Terms and Conditions at any time.The most current version will always be available through our website and becomes effective immediately upon publication.
